1. Agreement to Terms

By creating an account or using the Always There For You mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Always There For You regarding your use of the App.

2. Eligibility

You must be at least 13 years of age to use the App. If you are between 13 and 18 years old, you must have the consent of a parent or legal guardian to use the App. By using the App, you represent and warrant that you meet these eligibility requirements.

We reserve the right to request verification of age or parental consent at any time and to suspend accounts that do not meet these requirements.

You retain ownership of all content you create and share through the App, including messages, voice notes, care requests, calendar events, and profile information ("User Content").

By posting User Content, you grant Always There For You a limited, non-exclusive, royalty-free licence to use, store, transmit, and display your content solely for the purpose of providing and improving the App. This licence ends when you delete your content or your account.

Content Within Family Circles

Content you share within a Family Circle is visible to all members of that Family Circle. You are responsible for ensuring that you have the right to share any information you post, and that you have obtained any necessary consent from individuals whose information you include (such as emergency contacts or care-related details).

"Always There For You," the App logo, and related marks are trade marks of Always There For You. You may not use these marks without our prior written permission.

If you provide suggestions, ideas, or feedback about the App, you grant us the right to use that feedback without restriction or compensation to you.

15. Governing Law and Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. If you are a consumer resident in Scotland, you may also bring proceedings in Scotland. If you are a consumer resident in Northern Ireland, you may also bring proceedings in Northern Ireland.

Informal Resolution

Before filing any formal legal claim, we encourage you to contact us at support@alwaysthereforyou.app so we can attempt to resolve the dispute informally. We will endeavour to respond within 14 days.

Jurisdiction

Any disputes arising from or relating to these Terms or your use of the App that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where you are a consumer and are entitled to bring proceedings in the courts of your country of residence.

Alternative Dispute Resolution

If you are a consumer and we are unable to resolve a dispute, you may be entitled to refer the matter to an alternative dispute resolution (ADR) provider. You can find information about ADR at the Citizens Advice website (citizensadvice.org.uk).

17. Changes to These Terms

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction, provided that such assignment does not reduce the protections afforded to you under these Terms.
